Orchestre de l’Agora (the “Orchestra,” “we,” “our”) is committed to taking the necessary measures to respect the principles and requirements concerning the protection of privacy and personal information under applicable legislation. This Personal Information Protection Policy (the “Policy”) applies to services offered by the Orchestra, its subsidiaries, and affiliated companies under the domain orchestreagora.com and the sub-domain galadelaterre.com, (the “Site”).

Your privacy is our main concern. Our goal is to ensure the confidentiality and security of the personal information you provide us and to protect this information in accordance with applicable privacy laws. This Policy explains our privacy and security practices. In this Policy, personal information refers to information that can identify an individual, directly or indirectly.

Personal information collected and purpose

As part of our activities, we may collect personal information from you. We only collect personal information that is necessary to provide you with our various services. We collect personal information about you:

  • when you contact us (by email, phone, through our social networks, by mail, or in person), we may collect your name, email address, postal address, telephone number, as well as the company for which you work. This information allows us to provide the information, products, or services requested and communicate with you regarding your contact request;
  • when you purchase tickets for one of our events through one of the ticket-buying platforms with which we partner (such as Ticketmaster, Tuxedo, and lepointdevente.com), we receive from these third parties your name and email address, as well as the details of your ticket(s). We do not directly collect payment-related information, which is processed by the ticket-buying platforms;
  • when you make a donation or participate in one of our fundraising activities, we collect your name and contact information. We do not directly collect your credit card information, which is collected and processed by a third-party service provider (such as Zeffy or Race Roster);
  • when you subscribe to our newsletter or register for a promotional activity, we collect your name and email address in order to send you promotional emails about our activities and promotions that may interest you. You can choose to change your preferences by following the “unsubscribe” link provided at the end of the email or received communication. We use this information to provide information about current and future products and services or other developments concerning our organization;
  • when you respond to a survey launched by the Orchestra, we use the information collected to better understand how to improve our products and services (including through surveys conducted by us or on our behalf), develop and direct our activities and operations, and achieve other internal objectives;
  • if you apply for a position as an employee or volunteer, we will collect your name, email address, and any other information you provide to us, including your professional background. We use this information to evaluate your application and respond to it; and

Generally, personal information about you will be collected directly from you. However, we may collect personal information from third parties, to the extent permitted by law.

We may also collect personal information to comply with applicable legal and regulatory requirements, or for other purposes permitted by law. We do not collect personal information for other purposes, unless we have obtained the consent of the concerned individual.

How your personal information is used or disclosed

We use or disclose personal information only to the extent that is reasonably necessary to facilitate the objectives listed above. We may share your information with our affiliated companies when required to achieve these objectives.

In some cases, we may share personal information with third-party service providers performing functions on our behalf, including information technology service providers, performance venues, courier services, call center services, analytics or marketing services, and data hosting services.

We may also disclose your information in connection with a business transaction, in relation to financing, securitization, insurance, sale, assignment, or any other proposed or effective disposal of all or part of the Orchestra, or its activities or assets, for the purpose of evaluating and/or executing the proposed transaction. Assignees or successors of the Orchestra, or its activities or assets, may use and disclose your personal information for similar purposes as described in this Policy.

Finally, your information may be disclosed if necessary to satisfy legal, regulatory, or other insurance, audit, and security requirements, and otherwise with your consent, or as permitted or required by law (including as required by Canadian and foreign laws applicable to us or our service providers).

We do not sell, rent, or trade your personal information to third parties. Your personal information is distributed without your consent only to the extent permitted or required by law.

Retention of your personal information

We will maintain the confidentiality of your information and it will be used only in accordance with this Policy or applicable laws. We have implemented reasonable security measures to protect against theft, loss, misuse, or alteration of your personal information, such as the implementation of firewalls and encryption technologies, as well as restricting access to personal information to employees who actually need it.

However, it is important to note that any information transmitted over the internet can be intercepted by a third party. Therefore, we cannot and do not assume responsibility in case of theft, loss, misuse, or alteration of any personal information transmitted over the internet.

We retain personal information only for the duration required to achieve the purposes for which it was collected, or to meet legal, regulatory, or commercial obligations. When your personal information is no longer necessary, we destroy or anonymize your personal information to use it for subsequent purposes, in accordance with applicable laws.

Hosting and transfers of personal information

We will retain personal information on our internal servers or with service providers. It is possible that personal information collected about you may be stored and/or processed elsewhere than in Québec. Our service providers may store and process personal information outside Québec or Canada. When information is stored or processed outside your jurisdiction, it may be subject to the laws of the judicial authorities of those other jurisdictions and be accessible by them. Cookies and IP addresses

Visitors to our Site should also be aware that anonymous technical data may be collected during their visit. Effective date and amendment

This Policy, as occasionally amended, was adopted by the Orchestra on the last update date indicated above. We reserve the right to modify the Policy at any time. If we intend to use or disclose personal information for materially different purposes than those described in this Policy, we will make reasonable efforts to inform you, including by posting the revised Policy on our Site. By continuing to provide personal information or use our Site after any modification of this Policy, you accept these modifications.
